1. Introduction

This Copyright and Intellectual Property Protection Policy outlines the ownership rights of Karnival Pvt and its Users, prohibiting unauthorized use, copying, or redistribution of platform content, intellectual property, and user-generated content. The Policy complies with the Copyright Ordinance 1962, Trade Marks Ordinance 2001, PECA 2016, and the Companies Act 2017, as regulated by the Securities and Exchange Commission of Pakistan (SECP).

By using the Platform, you agree to respect the intellectual property rights of Karnival Pvt, its Users, and the corporate governance standards set by the SECP.

2. Ownership of Platform Content

2.1 Intellectual Property Rights of Karnival Pvt: All platform content — text, design, logos, images, graphics, code, software, and proprietary algorithms — is the exclusive property of Karnival Pvt or its licensors, protected under Pakistani law. Unauthorized use may lead to legal action under Section 56 of the Copyright Ordinance 1962.

2.2 Trademarks: The name, logo, and related marks of Karnival Pvt are registered trademarks. Unauthorized use is prohibited under Section 40 of the Trade Marks Ordinance 2001.

3. User-Generated Content

3.1 Ownership: Users retain ownership of uploaded content (e.g., listings, reviews, images). By posting, Users grant Karnival Pvt a non-exclusive, worldwide, royalty-free license to use, modify, and display this content for operational and promotional purposes.

3.2 Prohibited Activities: Users must not post content that infringes on others' intellectual property rights. By uploading content, you confirm you hold all necessary rights. Violations may lead to account suspension and legal action under PECA 2016 and Section 66 of the Copyright Ordinance 1962.

4. Protection of Uploaded Data

• 4.1 Data Ownership: Personal and transactional data uploaded by Users is governed by our Privacy Policy. Unauthorized copying or misuse is strictly prohibited.

• 4.2 Scraping and Data Mining: Automated scraping or data extraction without permission is prohibited. Offenders may face penalties under PECA 2016 and SECP regulations.

• 4.3 Misuse of User Data: Selling or redistributing user data without consent violates this Policy and may result in account termination and legal consequences.

5. SECP Articles and Corporate Governance

5.1 SECP Compliance: Karnival Pvt follows SECP's Articles of Association, covering intellectual property, operations, shareholder rights, and business conduct. Intellectual property use is aligned with shareholder value per Part VII of the Companies Act 2017.

5.2 Duties of Directors and Officers: Company officers must protect IP assets, manage data risks, and ensure legal compliance. Conflicts of interest must be reported under Section 208 of the Companies Act 2017.

5.3 Reporting: As per Section 130 of the Companies Act 2017, IP and data protection practices must be disclosed in annual filings and may be reviewed during annual audits.

6. Reporting Infringements

6.1 Filing a Complaint: If your IP rights are violated, contact our legal department. We'll investigate and remove infringing content as required by law.

6.2 Consequences: Violators may face account suspension, termination, and legal action under PECA 2016, SECP regulations, and Section 61 of the Copyright Ordinance 1962.

7. Policy Amendments

This Policy may be updated to reflect legal or operational changes. Users will be notified at least 30 days before significant updates.

8. Legal Jurisdiction

Disputes will be governed by Pakistani law, including the Copyright Ordinance 1962, Trade Marks Ordinance 2001, Companies Act 2017, PECA 2016, and SECP regulations.

9. Enforcement and Penalties

Violations may result in service suspension, civil claims, or criminal prosecution under PECA 2016 and the Companies Act 2017. Karnival Pvt reserves the right to take legal action to protect its IP, brand, and user data.
